1. Agreement
By using Cutaway (the "Service") at cutawaybg.com, you agree to these terms. If you do not agree, please do not use the Service.
2. The Service
Cutaway is a browser-based image tool that removes backgrounds and composes images on your device. Processing happens locally; we do not receive, store, or transmit your images. During launch, the Service is provided free of charge with no account, watermark, subscription, or payment required.
3. Your content and responsibilities
You retain all rights to the images you process. Because your images never reach us, we claim no license over them whatsoever. You are solely responsible for ensuring you have the necessary rights to the images you edit and for how you use the results, including compliance with applicable laws and third-party platform rules (for example, marketplace image policies or government photo requirements).
4. Acceptable use
You agree not to use the Service to create content that is unlawful, or to attempt to disrupt, reverse-engineer the hosted Service, or misrepresent edited images where doing so is prohibited (for example, falsifying identity documents).
5. Free launch period
The current launch version is free to use. We may introduce advertising, paid supporter options, or other monetization later, but no editing feature is currently gated by payment. If we add paid options, we will update these terms before they apply.
6. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. Automated image processing can produce imperfect results; you are responsible for reviewing outputs before relying on them (for example, before submitting marketplace listings or official documents).
7. Limitation of liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim (which, for free users, is zero).
8. Intellectual property
The Cutaway name, logo, site design, and site code are our property or used under license. The underlying machine-learning models and libraries are open-source software used under their respective licenses.
9. Changes and termination
We may modify or discontinue the Service, or update these terms, at any time. Continued use after changes constitutes acceptance. Material changes will be reflected by the effective date above.
10. Governing law
These terms are governed by the laws of People's Republic of China, excluding conflict-of-law rules.
